In the late Goryeo, the civil procedures were sharply increased and piled up due to social contradictions and the problems of civil procedure system. In this study, it is examined the causes and aspects of the flood of civil procedures and the management status of the judicial institutions, focusing on the procedures related lands and slaves, and considered the countermeasures established by the government to solve the problems.
At the period, there were rampant the procedures because of Geojib and Namjib as the way of the powerful’s illegal farm expansion, Hapjib on inheritance, and Ingjip ignoring judgment. And Because the official and private documents were damaged or lost due to the wars and fires, it was difficult to verify the evidence and proceed the civil trial quickly. It was also problem that increase of procedures that ignore the court hierarchy system and of institutions for the civil trial in the center excessively. Moreover, as the Yuan Dynasty meddled in Goryeo’ judicial domain, many attempts were appeared to get favorable judgment depending on it.
To solve the problems, the Goryeo government banned filing a civil procedure with the higher court directly against the court hierarchy system, and established the special judicial institution such as Jeonminbyeonjeongdogam. And since the King Gongmin’s reign, new laws that limit the procedure to prevent flooding of it and allow speedy trials were enacted. The civil procedure issues involving lands was settled by implementing the reform of the land system and Gwajeonbeop. However, the fundamental solution of the procedure involving slaves couldn’t be carried out because it was unable to break down the hereditary slavery system. Instead, the neo-confucian literati tried to improve the procedure system, and the legislations enacted at that time were inherited in the early Joseon Dynasty with the solutions through Nobibyeonjeongdogam.
