This article assessed the categories of Silla laws within the East Asian legal system, with particular focus on laws of education that can be verified through historical records. The study confirmed that there were approximately 31 categories of Silla laws that have been verified so far. Additionally, the study evaluated the feasibility of restoring Silla’s laws of education by comparing them with those of the Jin (晋) and Tang (唐) dynasties, and Japan (日本). Undoubtedly, it remains unclear whether the Silla laws were published or promulgated in the form of a legal code, although it has been well established that there existed the laws(律令格式) that were believed to have operated in some form or the other by Silla. However, the form they assumed is still debatable. This article confirms the categories of laws through the remaining pieces found in historical records and offers a partial explanation of how Silla"s laws of education, with abundant historical records, specifically shared commonality with and differed from Zhongyuan (中原) and Japan. It is difficult to suggest the contents and characters of Silla laws based solely on its laws of education, but it is plausible to make a rough assumption based on them.
It is imperative to investigate whether Silla laws were in the form of laws (律) or decrees(令) in future. Although current research on Silla laws is understandably constrained owing to the lack of historical evidence, most researchers agree that the research direction should take a slightly more empirical and specific approach. Therefore, the significance of this study lies in the fact that it proposed such a direction even though it assumed a somewhat limited approach using only laws of education and made some bold assumptions. Furthermore, the understanding of university or higher education represented by Gukhak (國學), which was Silla"s national higher education institute, can be further improved by a comparative study on the laws of education.
