Report Errors
Refugees in Asia have been suffering from insufficient refugee protection in the region. It is common in Asia that most states are not committed to the international refugee regime by rejecting either the institutionalization or the implementation of the international refugee laws. Most of the Southeast Asian states reject the formal ratification of the 1951 Refugee Convention, while East Asian states hesitate to implement refugee protection despite the formal ratification. In this regard, this research begins with two questions: what makes failures of international refugee protection in the Asian context? How does Asian civil society enhance refugee protection despite the non-compliance of state parties? This research argues that Asian civil society tries to reframe refugee protection by utilizing the paradox of the empty promise and the international regime complexity. As a result, Asian civil society has been contesting the current refugee protection in which is based upon the principle of the “right to seek asylum” by emphasizing the “right to enjoy asylum.”
