Demographic change is one of the major social changes in recent years. And the core trend of these demographic changes is the declining birthrate and aging population. As for the current demographic structure, the number of young people is decreasing due to the falling fertility rate and the proportion of the elderly is increasing, and this trend is expected to continue for the time being. This reality we are now facing causes the need for a systematic response through paradigm shift rather than recognizing the low birth rate and aging population as a unique population phenomenon. The low fertility and aging population is a social phenomenon that appears as a relatively large number of people choose not to conceive and have children. And since these backgrounds and causes have limitations that are difficult to overcome by individual strength, not only the basic view of 'the right of pregnancy and childbirth', but also the problem of social integration through national identity, issues of sustainability and intergenerational justice, etc. It is necessary to discuss public law from the point of view of national tasks. In conclusion, in response to the low birth rate and aging population, national policies should not only maintain national sustainability, but also create a fertility and parenting-friendly environment so that individuals can respect their choices and happiness. In addition, in order to improve the social and economic structure, which is the cause of the low birth rate and aging population, it is of utmost importance to set the legislative direction considering the stabilization of the working environment and the sharing of the burden of childrearing through work-family balance. Now is the time to sympathize with the seriousness of the low fertility and aging problem and to focus on solving the direct cause of the problem.

인구변화는 최근 주요한 사회변동의 하나이다. 그리고 이러한 인구학적 변화의 핵심적 흐름에는 저출산과 고령화 현상이 있다. 현재 인구구조는 출산율 저하로 인해 청년층이 감소하고 노령인구의 비중이 높아지고 있는데, 이러한 추세는 당분간 지속될 것으로 예상된다. 우리가 직면하고 있는 이러한 현실은 이제 저출산·고령화 상황을 특이한 인구현상으로 인식하기보다는 패러다임 전환을 통한 체계적 대응의 필요성을 야기시킨다. 저출산·고령화 현상은 비교적 많은 수의 사람들이 임신과 출산을 하지 않기로 선택함에 따라 나타난 사회적 현상으로, 그 배경에는 임신과 출산에 대한 선택에 영향을 미치고 있는 한국의 사회·경제적 구조와 현실이 있다. 그리고 이러한 배경과 원인은 개인의 힘으로는 극복되기 어려운 한계를 갖기 때문에, ‘임신과 출산의 자유’라는 기본권적 관점뿐만 아니라 국가정체성을 통한 사회통합의 문제, 지속가능성과 세대 간 정의의 문제 등 국가적 과제의 관점에서의 공법적 논의가 필요하다. 결론적으로 저출산?고령화 현상에 대한 국가정책은 국가의 지속가능성을 유지하는 것뿐만 아니라 개인이 선택과 행복이 존중될 수 있도록 출산과 양육 친화적인 환경을 조성하는 방향으로 이루어져야 한다. 아울러 저출산·고령화 현상의 원인인 사회·경제적 구조 개선을 위해 노동환경의 안정화와 일과 가정의 양립을 통한 양육 부담의 분담 등을 고려한 입법 방향의 설정이 무엇보다 중요하다. 지금이야말로 저출산·고령화 문제에 대한 심각성을 공감(共感)하고, 문제의 직접적인 원인 해결에 집중하여야 할 시점이다.
