The 2019 Supreme Court ruling, which recognized the principle of advantage, caused a lot of confusion in academia and practice due to unclear expressions and incorrect application of issues as reasons for the ruling. As a result, the Supreme Court"s ruling should be made carefully in that a large number of unnecessary social costs have been spent. Fortunately, some ambiguity was resolved through the 2022 ruling, but I don"t think the meaning and scope of the advantage principle have been accurately identified.
The key achievements we have gained from the above confusion are to determine which norms were advantageous over other norms at the time of establishment in determining the principle of advantage. However, if it becomes relatively advantageous over time, the principle of advantage does not apply. In addition, in the case of labor contracts, where the principle of advantage is mainly a problem, it can be seen that advantageous labor contracts are recognized because they are special in labor law principles compared to other norms. In addition, if the employment rules are advantageous compared to collective agreements at the time of their establishment, they will be recognized in that the key basis for recognizing the principle of advantage lies in worker protection.
