This thesis focuses on how to improve the settlement rate from mediation for copyright disputes. First, the current status of mediation for copyright disputes was examined through statistics. Next, the characteristics of copyright disputes, such as the fact that the amount of damages claimed is relatively small compared to the difficulty of the case and that prompt settlement of disputes is absolutely necessary for preventing the spread of damages, were discussed. Then, the cause why the mediation success rate of copyright disputes remains at a low level was analyzed. Finally, in response to this cause, measures to improve the success rate of mediation for copyright disputes were reviewed by dividing them into two mediation procedures; one is the mediation conducted by the Korea Copyright Commission receiving a direct application, the other is the court-connected mediation, in which the judge in charge of mediation entrusts the Korea Copyright Commission with mediation for copyright dispute cases filed in the court. In addition, measures to improve the success rate of mediation for copyright disputes were reviewed in the areas of the agencies/subjects in charge of mediation, mediation types and processes, and related laws and systems.

저작권 분쟁조정은 크게 ‘한국저작권위원회의 조정부에 의한 조정’과 각급 법원에서 한국저작권위원회로 사건을 배정·송부하여 처리하는 ‘법원연계형 조정’으로 나뉜다. 전자의 경우, 당사자 신청에 의한 일반 민사조정사건의 조정성립률과 비교할 때 그 조정성립률이 낮은 수치로 보기는 어렵지만, 기대만큼 조정에 의해 해결되는 사건 수와 조정성립률이 높지는 않은 것이 현실이다. 후자의 경우, 각급 법원에서 배정·송부하는 사건 수가 일정 수준에 미치지 못할 때에는 조정성립률의 제고를 기대하기 어렵다. 저작권 분쟁은 사건의 난이도에 비해 피해 청구금액이 소액인 경우가 많고, 신속한 분쟁해결이 절대적으로 필요한 특성으로 인해 변호사 선임을 통한 민사소송보다는 조정에 의한 신속한 해결이 더 적합하다. 저작권 분쟁에서 조정성립률이 저조한 원인으로는 분쟁해결 방식으로서 소송이 우선적인 법문화, 저작권 분쟁조정 제도에 대한 인식·홍보의 부족, 저작권 침해에 대한 형사적 구제의 우선 현상을 들 수 있다. 한국저작권위원회의 조정부에 의한 조정에서의 조정성립률 제고 방안으로, 신속한 조정절차를 위한 집중심리 실시, 당사자의 의견진술 기회의 충분한 제공과 경청, 법원과 한국저작권위원회 사이에 배상기준의 협업·공유를 통한 법원 판단과의 조화 방안 마련, 다양한 전문가의 조정인 선정, 국선 조정대리인 제도의 도입, 조정위원에 대한 지속적인 조정기법 교육과 역량 강화의 제도화를 제안하였다. 법원연계형 조정에서의 조정성립률 제고 방안으로는 연계형 조정사건 배정 건수의 확대 노력, 항소심 단계에서의 조기조정 실시를 제시하였다. 그 밖에 저작권 분쟁의 조정성립률 제고 방안으로서 저작권 분쟁조정 제도 홍보와 인식 강화를 통한 국민 신뢰도 개선, 저작권 침해에 대한 형사적 구제제도 개선 논의의 병행이 필요하다는 점을 지적하였다.
