Health and medical data are highly private and sensitive to national security, and both South Korea and China have set special rules for the cross-border flow of health and medical data. Due to the different regulatory logic, it is difficult to effectively align the rules between South Korea and China, and the cross-border flow is blocked. After the RCEP came into effect, its concept and rules on cross-border data flow provided inspiration for the alignment of rules between South Korea and China. How to use RCEP to promote the cross-border flow of health and medical data between South Korea and China is a common task facing the two countries. Specifically, South Korea uses a separate agreement rule as the general rule for cross-border transmission of health and medical data, while China uses “data exit security assessment” as the general channel for cross-border transmission of health and medical data. There are big differences in the rule system built by the two sides. This has led to the triple dilemma of channel conflict, RCEP channel purpose limitation and lack of unified standard in cross-border transmission of health and medical data between South Korea and China. In this regard, this paper proposes three countermeasures, including adjusting China’s cross-border data channels, broadening the scope of RCEP purposes, and introducing general technical standards for cross-border regional medical data, which are expected to balance the demand for cross-border data flow and utilization with the demand for data security and privacy protection.
