Although the Constitutional Court of Korea (CCK) permits film-rating system considering the social influences of films may have, but the Court simultaneously points out that it is anticonstitutional if the rating procedure is exclusively handled by governmental institution. Specifically, CCK has declared that the current film-rating system, which is managed by Korea Media Rating Board (KMRB), is anticonstitutional because KMRB is a governmental institution, legally forcing all film producers to submit their products for review, preventing the release of films without KMRB's rating. In addition, the current system also applies arbitrary and dual standards, which is prohibited by the law, and consequently leads to illegal violation of rights. A possible solution which might be suggested is to establish non-governmental system of film ratings which is managed by civil groups as seen in the US and Great Britain.
