The purpose of this essay is to investigate whether or not the Korea Media Rating Board is violating the constitutional Freedom of Expression which our Constitution guarantees. The Freedom of Expression which is the basic foundation for the political decision makings is very important for the maintenance of the system of Democracy. Since Movies are a form of communication media, freedom of expression should be applied to it even though it is a form of entertainment and industry as well. If Freedom of Expression which our Constitution guarantees is applied fully on movies, our rating system which has the power to limit the possibility of showing of certain films is unconstitutional.
First, the fact that the governmental Rating Board exercise censorship is unconstitutional.
Second, the current Motion Picture Act which authorizes the board to decide whether or not a film is to be shown is unconstitutional.
Third, the possibility that any movie under our rating system could be banned from adult viewing is also unconstitutional.
The basic point of the proposed bill to revise the Motion Picture Act in 2000 seeks to authorize the Board the right to not classify certain movies and to implement a system for restricted adult-only theaters. But these provisions are worthless in part.
The first problem with the Bill is that the Board still have the right to restrict the showing of any movie.
Second, it is improper and difficult for the committees of the Board who are not specialists in law to make any legal decisions.
Third, the classification of movies with the three ratings (NC-19, Restricted Permission and No Rating) for underage viewers is meaningless.
I' d like to make some proposals to improve our current movie rating system.
First, the introduction of a 'Restricted Permission rating is improper. The board should classify only the movies which they are able to. and those movies which they do not classify should be permitted to be shown at the special theaters for "No rating" movies.
Second, any movie which contravene any current criminal act should be punished by the court through criminal and administrative process. The Board should not decide whether a movie violates existing law beforehand.
In conclusion, the current rating board under the control of government should be abolished and a voluntary movie rating system be introduced.
