This thesis discusses the necessity of adopting interconnection regulations into a broadcasting industry, which have been used to open networks and keep competition in a telecommunication industry. The most conspicuous characteristic of the telecommunication industry in 21st century is the 'digital convergence'. In particular, the convergence of telecommunication and broadcasting industry causes the broadcasting industry to adopt the same rules to open its market as in the telecommunication industry. Data broadcasting (or, interactive television ("ITV")), which is one example of the harmonization of the telecommunication and the broadcasting industry, will show that the interconnection regulations will be critical to give opportunities to new entrants in this newly appearing industry.
The broadcasting industry is rapidly entering the era of digitization, which enables TV to have interactivity as of telecommunication devices. Since the data broadcasting services' appearing (ITV services), several questions about whether current regulations just keeping broadcasting networks closed need to be changed have been raised. Similarly as in the telecommunication industry, network operators in the broadcasting industry have enough factual power to deny entrants' access to the new data broadcasting service market by controlling a main broadcasting line, a return path, and a set-top box protocol. In this reason, without appropriate new rules to allow users be able to connect new terminal equipments to the prevailing networks and experiments with new networks, the new service providers for data broadcasting could not come into the broadcasting networks.
The interconnection rules could guarantee users' non-discriminatory access to network components, thereby facilitating the introduction of new services and increasing consumer welfares. The new data broadcasting service providers' access to the of network operators' multi-channels is just one example of open network regulations in the broadcasting industry. The interconnection rules could be used as, at least, a method to enforce the pre-existing network operators to permit new service providers to access their networks, hence inducing more competitions into the broadcasting industry.
