This article explores into legal problems surrounding regulation of prohibited activities in the Korean broadcasting markets(hereafter “markets”) which have been introduced or contemplated for introduction into the broadcasting-related laws. Apart from on-going arguments regarding who and by which regulates the markets from the perspective of competition and fair trading, I assume that the current market situations under construction towards effective competition require sector-specific regulation by the regulatory agency which would be effectively enforced through regulatory framework in the form of prohibited activities in a limited time. The main body of this article is divided into three parts: First, a brief overview of general issues related to competition and fair trading particularly in the existing pay-TV markets comprising System Operator(“SO”), satellite broadcaster and Program Provider(“PP”) and relevant provisions under the Korean Broadcasting Act. Second, more detailed inquiry into legal issues raised by the distribution of and access to broadcasting programs or channels causing to impede a basis of competition on the merits between existing media platforms and likely legal methods addressing to these matters with a special emphasis on the Program Access Rule of US and the Universal Access Rule of UK and EU. Third, the explanation of the background and substances of the Internet Multimedia Broadcasting Business Act which is recently enacted for the regulatory regime of the Internet Protocol TV(“IPTV”). As the distinct regulatory framework admits market-dominant key telecommunications operator as a new entrant into the existing markets with broadcasting-telecommunications convergence services such as IPTV, it remains to be seen how integrated regulatory agency dealing with both broadcasting and telecommunications issues would coordinate available policy means so as to create competitive markets based on level playing field in addition to settling regulatory inequality problems.
