Recently, community custody(house arrest) receives much attention as a new alternative to imprisonment due to the fact that community custody combined by electronic monitoring enables remote sensing through high technology. As the traditional concept of confinement using prison has expanded, community custody(house arrest) is expected to be used as an alternative to pre-trial detention and monitoring high-risk released prisoners as well as to prison time. Accordingly, it is argued that prison needs to be employed as a last resort to house an offender who poses a serious threat to public safety. The current study reviewed previous research on community custody, examined several countries’ legislation of community custody, and investigated implementation of community custody. In addition, several critical issues on implementing community custody and enacting community custody as one way of sanctions are also discussed. In conclusion, four policy implications are presented. First, although community custody is expected to an alternative to imprisonment, it needs to be differently operated from traditional community-based sanction such as probation. Second, for an effective community custody sanction, situations and opinions of family members and victims need to be included in operating community custody. Thirds, beyond the alternative to imprisonment, the use of community custody can be expanded into alternatives to pre-trial detention and monitoring high-risk released prisoners. Fourth, through building partnerships among law enforcement, courts, corrections and probation, sufficient resource for implementing house arrest needs to be established.
