Big Data is often defined in terms of the sheer volume of data from different sources combined with mass storage devices and informational tools that analyse this data. Volume of data, variety of data resources and velocity of analysis speed should characterise Big Data. The author proposes a different approach to this term. From his point of view this notion of Big Data is a bit misleading for at least two reasons: it seems to refer only to the aspects of data and it seems to be technological. Instead, he thinks that Big Data is more of a phenomenon and a complex social practice. It comprises not only data, data storage hardware and software and data analytic tools but also the social practice of using Big Data technologies for societal purposes. Therefore, he proposes that Big Data may best be viewed as a method of generating new knowledge. He goes on to say that in a democratic and open society, the generation of new knowledge is appreciated and covered by various legal guarantees. As a new form (technology), it is accompanied by great promises as well as great fears. Whether these expectations will be met remains uncertain, at least for the time being. However, this social practice has the potential to at least call into question some important institutional arrangements, e.g. aspects of the approach to data protection or other basic conceptions. Regulatory efforts thus seem unavoidable. However, a number of answers seem to be possible. Before advocating for regulation, it seems expedient to observe its development instead of taking the possible threats as a starting point for regulatory efforts. There is good reason to expect that even this new form of automatically generated knowledge will be embedded in society. Together with the adaption of the legal framework due to arising or existing problems, this will form a new regime of knowledge.
