Since the Roman law, the lawyers have been incessantly engaged in the hard question how to deal with the contract concluded under influence of a mistake (cf. art. 109 of the Korean Civil Code). A special attention was given to the mistake in motive, i.e. the mistake in the formation of a party’s intention. The leading opinion in Korea, followed by the case law, insists that a contract may be avoided if its mistaken party, concluding the contract, expressed his/her motive to the other. There are, however, many critical voices concerning this doctrine. At the same time, the reform ideas which consider the international model rules (PICC, PECL etc) are vigorously suggested.
This article aims to contribute to this state of discussion by interpreting the art. 109 of the Korean Civil Code form a new perspective. It starts from a typology of the mistakes in motive which frequently appear in the practice and analyzes their structure with evaluating criteria inherent in the Civil Code. It is thereby shown that the results attained by and large correspond to the model rules of PECL. It is furthermore submitted that other forms of mistakes which are to be called mistake in communication can be better apprehended on the basis of the new approach. The author’s main conclusions are as follows:

1. A motive can be integrated into the contents of a contract, and it justifies an avoidance of the contract which is caused by mistake concerning the motive.
2. In case of a common mistake, the parties’ hypothetical will has to be considered; when it is not possible, an avoidance is allowed.
3. A mistake caused by the other party justifies an avoidance of the concerned contract.
4. A mistake about future circumstances is to be considered insofar they indicate to an evaluation of the present circumstances.
5. A mistake in communication is avoidable on the ground of lacking the mistaken party’s autonomy.
