Many jurists have held that there are occasions when the application of an existing statutory rule or legal theories leads to an unjust or inconsistent result. In such cases it is said that legislators or judges are forced to make a difficult choice. One way out of the dilemma, according to some, is accomplished by legal fictions. But the basic problem is that a legal fiction is, by definition, untrue. The essay focuses a debate on the nature, raison d’etre, and justifiability of legal fiction. What is a legal fiction? When and why occurs a legal fiction? Can it be justifiable? First, we have to define a legal fiction. Generally a fiction is a counterfactual perception in se or means of counterfactual perception. Legal fiction is a counterfactual assumption of fact made by a legislature or a court, as the basis for resolving a legal issue. Second, legal fictions occur with the purpose of identifying somethings with unequal things or the purpose of understanding law itself or main legal concepts. Legal fictions are necessary to carry out the various goals of a legal system. It functions as a tool of legislative techniques or legal politics. Lastly, a legal fiction can be justified insofar as it pursues justice or equity. Legal fiction is a justice conductive falsehood. But it is justifiable as a ultima ratio in the absence of another legislative of juristic methods. But understanding utilities and dangers of legal fictions takes us into the realm of legal truth itself, and into a confrontation with the complex relationship between legal truth and legal language. It requires the renaissance of jurisprudence or philosophy of law.
