Foreign workers account for a large portion of the nation’s labor demand and are on a steady rise, and are required for the local labor market. Based on the current Foreign Workers’ Employment Act, this research paper discusses individual and issue-by-point whether the legal system is valid from a normative and realistic perspective to overcome the difficulties of the industrial field. In particular, he was aware of the economic instability factors such as the corona crisis as well as the economic instability and suggested some problems and improvement measures from a normative perspective, focusing on the employment of foreign workers, who account for the majority of the nation’s foreign workforce.
The regulation of domestic employment relations for foreign workers with simple functions under the Foreign Workers Employment Act may be regarded as an appropriate management of foreign workers’ stay in the legislative purpose. However, if we take a closer look at whether it is appropriate for the social reality and consider the conditions of the industrial field, there are some improvements and needs to be reviewed. In particular, a series of poor social and economic conditions related to the corona crisis can lead to a gap between the reality of the industrial site and the legal effectiveness of the foreign workers entering the country after they enter the country. In reality, even if the state or users did not intend it, there is room for each system to be used unfairly by foreign workers, such as the employment permit system, workplace change, employment change report, and exit maturity insurance.
Foreign workers currently staying in our society should not be perceived as simply providing work when we need it and returning to their home country when a certain deadline arrives. At least during our stay in Korea, we are forming large and small living and legal relationships directly and indirectly, so our country should recognize social integration with foreign workers as an important issue. After the Corona 19, the nation’s labor market will have to face even greater changes, and it should not stop just from the issue of increasing the labor force of foreign workers. Changes in the economic situation and the challenges of social integration will be combined, and the problem of hiring foreign workers should not only be dealt with in regulations, but should be approached from a long-term perspective from the perspective of normative regulations considering industrial and economic conditions.
