In this paper, I analyze the reasons why the Czech Republic and Slovakia chose different mechanism of transitional justice and examine whether the National Memory Institute in Slovakia succeeded in establishing transitional justice. Firstly, I classify the transitional justice in post-communist states into ‘judicial justice’, ‘personnel justice’, ‘truth justice’ and ‘reparation justice’, and analyze which justice Slovakia has focused on. And I divide the development of transitional justice in Slovakia from lustration law in 1991 to enactment of the National Memory Act in 2002 into three periods, and examine the main characteristics of each period. And in the next chapter, I compare ‘personnel justice’ in Czech with ‘truth justice’ in Slovakia and analyze the reasons for choosing different justice. And in the final chapter, I summarize the different mechanism of transitional justice between the two countries, and argue that in political reality, both the personnel justice and truth justice deviate from the original goal of transitional justice.
