The Constitutional guarantee and limitation of Local Self-Government appear as guarantee and limitation of Local Self-Governing Body, Local Self-Governing functions and affairs. Resident Self-Governing Basic Bill, currently pending in the National Assembly, stipulate a residents' assembly as the highest decision-making body composed of residents in eup, myeon, and dong as the nature of the local council in order to realize residents' autonomy. The Bill Article (9) and (10) stipulate the Local Residents' Autonomy Committee and Local Self-Government established by residents as institutional integration-type, which is the executive incorporated as Juristic Person under Public Law. According to the Constitution of the Republic of Korea, Local Governments take the institutional confrontation centered Collective Autonomy. There are improvements in this part. And also, the Bill Article (11) stipulate that the residents shall be the members of the Residents' Self-Governing Council through a lottery system. According to the Bill Article (7), the qualifications of residents in the local area is as follows: 1) a person registered as a resident; 2) a person on the domestic resident registration list by Act on the Immigration and Legal Status of Overseas Koreans; 3) a person registered on the registration of foreigners for three years after the date of acquisition of the permanent residence status by Immigration Control Act; and 4) a person who can become a resident by the Residents' Self-Governing Council through separate procedures prescribed by the local ordinance. However, according to the Constitution of the Republic of Korea, the residents must be the nation of the Republic of Korea. And so, there are improvements in this part, too. Moreover, the Bill Article (12) and (13) stipulate that employees of the executive office of the Residents' Self-Governing Council become local public officials under the Local Public Officials Act, and the Nation provides all or part of the necessary expenses of the Residents' Self-Governing Council. In this part, the National Assembly should need to improve the provisions of the Bill in detail.
