The Constitutional guarantee and limitation of Local Self-Government appear as guarantee and limitation of Local Self-Governing Body, Local Self-Governing functions and affairs. Resident Self-Governing Basic Bill, currently pending in the National Assembly, stipulate a residents' assembly as the highest decision-making body composed of residents in eup, myeon, and dong as the nature of the local council in order to realize residents' autonomy. The Bill Article (9) and (10) stipulate the Local Residents' Autonomy Committee and Local Self-Government established by residents as institutional integration-type, which is the executive incorporated as Juristic Person under Public Law. According to the Constitution of the Republic of Korea, Local Governments take the institutional confrontation centered Collective Autonomy. There are improvements in this part. And also, the Bill Article (11) stipulate that the residents shall be the members of the Residents' Self-Governing Council through a lottery system. According to the Bill Article (7), the qualifications of residents in the local area is as follows: 1) a person registered as a resident; 2) a person on the domestic resident registration list by Act on the Immigration and Legal Status of Overseas Koreans; 3) a person registered on the registration of foreigners for three years after the date of acquisition of the permanent residence status by Immigration Control Act; and 4) a person who can become a resident by the Residents' Self-Governing Council through separate procedures prescribed by the local ordinance. However, according to the Constitution of the Republic of Korea, the residents must be the nation of the Republic of Korea. And so, there are improvements in this part, too. Moreover, the Bill Article (12) and (13) stipulate that employees of the executive office of the Residents' Self-Governing Council become local public officials under the Local Public Officials Act, and the Nation provides all or part of the necessary expenses of the Residents' Self-Governing Council. In this part, the National Assembly should need to improve the provisions of the Bill in detail.

지방자치의 헌법상 보장과 한계는 자치단체, 자치기능, 자치사무의 보장과 한계로 나타나는 바, 현재 국회에 계류 중인 주민자치기본법안의 경우에는 주민자치를 실현하기 위하여 자치의회의 성격으로서 읍·면·동의 주민으로 구성되는 최고의결기관으로 주민총회를 두고, 주민총회에 의하여 자치행정의 성격으로서 집행기관인 주민자치회를 법인으로 하여 주민에 의하여 설치하는 기관통합형 자치기관을 상정하고 있는데(법안 제9조 및 제10조), 이는 우리나라 헌법상 지방자치단체는 단체자치 중심의 기관대립주의를 취하고 있다는 점에서 개선의 여지가 있다. 또한 이 법안에는 주민자치회의 구성은 추첨제를 통하여 주민이 그 위원이 되고(법안 제11조), 그 주민의 자격은 해당 지역에 1) 주민등록이 되어 있는 사람, 2) 재외동포의 출입국과 법적 지위에 관한 법률에 따라 국내거소 신고인명부에 올라 있는 사람, 3) 출입국관리법에 따른 영주의 체류자격 취득일 후 3년이 경과한 외국인으로서 외국인등록대장에 올라 있는 사람, 그리고 4) 조례가 정하는 별도의 절차를 통해 주민자치회의 주민으로 될 수 있도록 하는 간주규정을 두고 있는데(법안 제7조), 이는 우리나라의 헌법상 입법자의 입법형성에 의하여 주민을 정할 수 있다고 하더라도, 또한 설사 주민자치기본법안에 의한 추첨제 방식으로 선거를 할 수 있다고 하더라도, 자치기관이라는 그 성격상 선거권과 피선거권을 모두 가질 수 있는 주민등록이 반드시 되어 있는 국민에 한정되어야 한다고 할 것이므로, 국민이 아닌 외국인 또는 주민자치회가 정하는 사람을 주민으로 하고 그 주민이 주민총회 및 주민자치회의 위원이 되도록 하는 이 법안의 규정은 개선의 여지가 있다. 더구나 자치기관의 성격을 지니고 있어서 주민자치회 사무국의 직원을 지방공무원법이 적용되는 지방공무원으로 보하면서, 주민자치회의 예산은 국가가 필요한 경비의 전부 또는 일부를 지원하는 규정들을 마련하고 있다는 점에서도(법안 제12조 및 제13조), 이러한 법안의 규정들은 세밀하게 개선되어질 필요성이 제기된다.
