The purpose of this study is to find the tasks of housing rights for people with disabilities. Housing rights is main fundamental rights to subsistence, comfortable environmental rights and cultural fundamental rights. Especially adequate housing for handicapped people is essential to live independently.
Handicapped and non-handicapped people should be able to live together anywhere in the country. The reality, however, is that most handicapped individuals do not have opportunities for employment and housing because of insufficient support by government and social discrimination.
State policy should be focused on the handicapped to overcome discrimination substantially, cooperation between the private and public sectors in the course of implementing that policy is importance.
In this article, elicitations for adequate housing for disabled people in Social Security Acts and Housing Acts. ① The construction and adaptation of housing comply with regulations governing accessibility for persons with disabilities, ② Promoting the establishment, under governmental housing programs, of specific percentages of housing to be earmarked for persons with disabilities and their families are an example of this plan.
For Guarantee of housing rights for people with disabilities, Legislative improvement-devicies should be introduce as follow, ① Adequate housing for Handicapped people national rental housing in Housing Act and Rental Housing Act, ② Realization of a housing allowance and supporting housing-alteration in the 'Disabled Persons Welfare Law' , ③ Prohibition of discrimination housing in dealing or lease because of handicapped in 'the Disability Discrimination Act'.

우리나라의 장애인은 법제도적 차별 뿐만 아니라 사회적인 차별을 당하고 있다. 특히 장애인의 주거문제는 심각하다. 장애인에게 적합한 주거환경은 고사하고 최소한의 생존권적인 주거보장이 현실적으로 이루어지고 있지 않고 있다. 이 논문은 장애인의 열악한 주거환경을 개선할 수 있는 법제도적인 개선방안을 연구한 것이다.
장애인 복지의 궁극적인 목적은 장애인의 자립생활능력을 확보하는 것이다. 이는 장애인의 교육ㆍ이동권ㆍ노동권이 밑받침이 되어야한다. 이에 앞서서 장애인의 주택권(주거권)이 보장되어야지만 장애인은 이를 바탕으로 교육의 공간과 재활의 공간을 확보할 수 있다.
이 논문의 제2장 「장애인 주택권보장의 헌법적 기초」에서는 헌법상 장애인의 기본권ㆍ헌법상 주택권의 법리를 분석하고 이를 바탕으로 장애인 주택권보장의 의의와 필요성을 다루었다. 제3장 「우리나라 장애인의 주거현황」에서는 장애인의 주거현황을 살펴보았으며, 제4장 「장애인주거복지에 관한 비교법적 분석」에서는 외국의 사례를 비교 고찰하여 우리나라에 주는 시사점을 도출하였다. 그리고 제5장「장애인 주거복지개선을 위한 법제도적 개선방안」에서는 현재 우리나라의 장애인 관련 법률 및 주택관련법률에서 장애인의 주거복지에 관한 문제점을 고찰하고 그 개선책을 제시하였다. 특히 장애인이 그의 주거환경에 적합하게 살 수 있는 주거환경의 개조에 대한 문제를 중점적으로 다루었다.
이 논문에서 도출한 장애인 주택권 보장을 위한 개선방안으로는 첫째, 주택관련법령에서는 「장애인에 적합한 주택을 위한 주택개조의 지원」, 「장애인에 적합한 공용주택의 건설 촉진」을, 둘째로는 사회보장관련법령에서는 「장애인의 주택수당비 현실화」, 「주택개조비 지원」, 「장애로 인한 주택의 매매나 임대차 차별금지」 등을 제안하였다.
