To realize the original mission of General Principles of Criminal Law in revising Criminal Law and making or amending Special Criminal Act enactments, the interpretation, application and enforcement, as well as the process of lawmaking, has to be correctly operated. Only in that moment can the General Principles of Criminal Law surely devote its tasks that should be protected and guaranteed.
However, in South Korea, the purpose and execution of law has been neglected due to various reasons, and securing the human rights of criminals has also traditionally been disregarded. These are undeniable facts when we shed light on the history since the Democratic Republic of Korea has established.
Therefore, when enacting and revising law in the future, the mission of General Principles of Criminal Law should be securing the protection of the general public, as well as guarantee the human rights of criminals. In other words, raising security values to that of protective values is the overarching task of lawmakers in reshuffling General Principles of Criminal Law, and only at that time can the law gain justification.
The mission of lawmakers of General Principles of Criminal Law is to keep in mind that the philosophy of law is to make self reflection possible for the general public. Lawmakers, who had recklessly produced Special Criminal Acts for political purposes, have to take responsibility. They had ignored the reasonable decision-making process of the legal system and formation of laws. In addition to that, they had made rough and ready law using unorthodox ways. Now, it is high time that they should take it seriously and repent of the things they did before.
