Since the conservative and right-wing administration has born in 2007, a reactionism has extensively been widespread in korean society. In the korean judiciary, there are some signs to turn back to the past. The recent case of Justice Shin Yeong-Chul is a typical one.
In the light of korean constitutional history, the judicial independence was influenced, at first, by the character of political power, which held an administrativeand legislative power. The authoritarian political power that dominated R.O.Korea for a long time had made the judicial system of the constitutional law as an only functional regime rather than as a powerholder standing in rivalry with an administrative and legislative power. The democratization of political power, therefore, is a necessary precondition of a judicial independence. The Chief Justice and judges, however, can resist and protest to the political power to protect a judicial independence from a judicial infringement. This protest means political power struggle for the democracy and the rule of law and the judicial independence.
The judicial administration of the korean judiciary has two faces ; one is that of judicial power. The other is that of judicial function. The former means that the judiciary is a co-holder of political power and the latter means that the judiciary is one of state functions. In the korean constitutional history, the judicial administration has many problems. To sum up, there are problems as follows ; judge management system, the judicial budget system, the specialty of judges, the absence of a reasonable judicial performance evaluation system, a small scale of court system, th absence of autonomy of judicial administration in the inferior courts. For the judicial independence, it is necessary to amend the constitution including judicial system more precisely.
