The driving agency business can do business if it do only business report to the National Tax Administration Agency. This business does not need much investment capital. and many small-scale businesses repeat beginning and stopping at any time. This business began at the end of 1998 in small scale. and became bigger from the latter half of 2003. By the expansion of the market of the driving agency businesses, the accidents and the damages have increased continuously.
This case is that the insurance company of driving agency businessman compensated victims for loss at first and demanded the insurance money of B.J. from the insurance company of car owner later. After all, the core of this case is whether the car-owner has the driving liability when the accident by driving agency occurs.
This judgment is that the driving agency businessman has the driving liability with the car-owner in the outside relations but only driving agency businessman has the driving liability in the inside relations. I think that the meaning of this judgment is that the car-owner cannot have the driving liability originally but the car-owner has the driving liability under unavoidable circumstances to protect victims in the outside relations.
The highest court of our country ever judged that another person in Automobile Liability Security Law would be decided according as driving profit and driving governance were direct and concrete, or indirect and abstract. In other words, it means that while the car-owner has the nature of the driver, he can be the another person in Automobile Liability Security Law. I think that this method is the most superior method to minimize the confusion.
