There has recently been an increasing interest on the trade-related aspects of Yang-Kee Lee environmental considerations under the WTO mechanism whenever a proposal to incorporate the comprehensive rules to regulate individual countries' environmental measures into the WTO Agreements. The Uruguay Round was launched before environmental concerns had taken on their current prominence, and the relationship between trade measures and environmental measures was not included as a separate subject for negotiation. There has been little effective progress with respect to clarifying the relationships between the two policies and measures, however, trade and environment are both important areas of policy-making and should be mutually supportive in order to promote sustainable development, without undermining the open, equitable and non-discriminatory character of the WTO mechanism.
This article examines the effective ways to resolve the conflicts between trade measures and environmental measures particularly through the supplement to and the amendment of the current WTO provisions concerned - particularly Article ⅩⅩ, ? and redefinition of the term 'like product'. The discussion on the interpretation and implementation is made through the review of the GATT/WTO dispute cases concerning trade and environment measures.
