On the above, The importance and the object of interpretation applicated to int'l trade, and interpretation on CISG and PICC, possibility of application of both instruments in int'l trade, usefulness and priority in interpretation, the method of their practical use were discussed.
Conclusions are as follows :
Although both instruments have the provisions of interpretation, PICC set forth general rules for int'l commercial contracts is practical and useful, while CISG is the general and theoretical.
Interpretation of PICC is definite and systematic, while interpretation of CISG is inclusive. Therefore in case of CISG, the provision of interpretation could give to rise a misunderstanding and thereby dispute.
On the basis of MISC drafted and composed in 3 parts by ICC, new model designed on the assumption that parties would normally use in their int'l trade, must make out a draft more simple than MISC, that to say, as a while, it would design both parts, first part (the front) to be express terms agreed between both parties, second part (the back) to be obligations of performance including comprehension of interpretation on PICC and force majeure, resolution of disputes, etc.
If so, new model is applicable to any contract for int'l commercial transactions.
