This study, on the basis of investigating and analysing of the actual conditions of unfair commercial practices in the country and the legislative systems of home and abroad, aims to propose keynotes and draft for making rules in relation to unfair commercial practices.
This study can be largely divided in three stages. The first stage is investigating and analysing of the actual conditions of unfair commercial practices and the standing rules in the country. The second stage is analysis of relevant laws and regulations and recent movement of EU, UK, US, Japan. The third stage is suggesting policy direction based on the above investigating and analysing.
This study suggest keynotes and draft in making rules in relation to unfair commercial practices
The keynotes may be summarized as follows.
⒜ The unfair commercial practices notice should deal with the unfair commercial practices in general fields rather than the unfair commercial practices in specific fields.
⒝ The notice should deal with overall processes of trade including advertising, inducement, representation, contract terms, fulfillment of a contract, cancellation of a contract, etc.
⒞ The notice should include the unfair commercial practices which regulated under the Visiting Sales, etc. Act, Consumer Protection in Electronic Commerce, etc. Act, and more.
⒟ The notice should contain effective measures to prevent occurrence or enlargement of consumer damages
⒠ The notice should contain response to consumer damages which remain a concerns recently.
