【Abstract】 A Study on The Efficiency Model of The Korean Employment Insurance Act Oh, Gi Seop ․ Chung, Joo-Hwan This paper studied explored the legislation of the employment insurance law according to employment crisis, studying the legislation that was related to those who would be covered by employment insurance, would make the employment insurance business more efficient, and would allow labor and management to participate in the operation and policy-making process of the employment insurance system. Conclusionally, the coverage scope of the employment insurance law should be expanded to remove the blind spot. The law prescribes that every establishment with one or more employees must be insured. But the reality is that the employment insurance fails to cover all the employees but only half of them. That is an irrational discrimination and clearly violates the principle of equality in Article 11 of the Constitution. Moreover, the various kinds of grants stipulated in the Employment Insurance Act should be enacted or revised through evaluations to improve their efficiency. In addition to increasing their efficiency, the legislative measures will also create more jobs. Notwithstanding, the employment insurance law should focus on promoting the employment stability for non-regular workers, female workers, and elderly workers in the future. Since Korea is facing emerging social risks such as non-regular workers, low birth rates, aging, and female workers, it's increasingly necessary to devise employment policies. In particular, the excessive reserve of the employment insurance fund should be resolved as it leads to unnecessary projects and increases the labor costs, being detrimental to job creations. One way to resolve the problem is to revise the concerned law to introduce elastic rates of insurance.
