Religion pursues some higher good or ultimate end that goes beyond ordinary human endeavors and includes the possibility of personal transformation and transcendence beyond "this life." Religion and law share ritual, tradition, authority, universality, and morality. At times there is a conflict between law and religion. Criminal law plays the same role in man's social life that God's moral law plays in man's spiritual life. Criminal law has the deterrent and retributive function, attempts reconciliation with God, and includes the goal of rehabilitation or reformation. The Korean constitution declares freedom of religion and the separation of politics and religion. Therefore, government should treat every religion with fairness, and the regulation of religious institutes should be neutral. Imposing a substantial burden on the exercise of religion should meet compelling governmental interest and be in the least restrictive-means. Also, the religious beliefs of some should not be the basis for denying medical care to others, since no one has the right to inflict an injury on others in the name of religious freedom. With regards to the deific decree, Korean courts has been strictly regulating the insanity defense. When it comes to conscientious objection to military service, skepticism or disbelief in the existence of God or a Supreme Being does not mean lack of faith. A belief in and devotion to goodness and virtue for their own sake and a religious faith in a purely ethical creed could be regarded as a justifiable reason; not just political, sociological, or philosophical views or a personal moral code. Also, regarding defamation and freedom of religion, it is necessary to weigh the conflicting interests.
