The purpose of this Research is as follows: to carry out a comprehensive analysis and review of the legal systems across ICT sectors; to identify conflicting and overlapping ICT statutes enacted and amended over the years, and suggest improvements for the legal systems to ensure efficient and systemic operation of ICT policies; and to propose detailed phased plans for the improvement of legal systems across ICT sectors. This Research seeks to carry out a comprehensive analysis and review of the legal systems across ICT sectors and draw out improvements for ICT sectors based on the consideration of the target, scope, and purpose of each statute to ensure the efficient and systemic operation of ICT policies. The Research is also aimed at establishing detailed phased plans for the improvement of the legal systems across ICT sectors, which will be used as foundational materials for the improvement of the ICT legal systems. Phase 1: Restructure the overall system of ICT laws, and carry out a demand survey for ICT law improvement. Phase 2: Restructure the system of regulation laws. Phase 3: Restructure the system of promotion laws. Phase 4: Restructure the system of ICT convergence laws. To improve ICT legal systems, 1) the “Framework Act on ICT Convergence” needs to be enacted to identify and systematize ICTs. 2) ICT-related authorities currently distributed across various organizations need to be integrated. 3) The regulatory system under ICT laws should be transformed into a negative regulatory system.
