This paper aims to investigate the changes of ‘the Law of Local Autonomy’ in Korea as an evolutionary process. Institutions including legal systems evolve depending on ‘Natural Selection’ or ‘Social Adaptation’ by or to environments and situations that they serve. Evolutionary process in this paper is based on the social evolution theory developed by Spencer(1820-1903) after Darwinism. But this paper modified the social evolution theory in part to explain institutional change like laws and acts. The Law of Local Autonomy was enacted in 1949, one year after the 1948 establishment of the Korean government, on the basis of ‘Democratic System’ against the North Korea colored with ‘Communist System’. Korea has gone through the modernization waves and harsh environment, such as the Korean war(1950-1953), industrialization, democratization and restructuring its social system. These environmental changes made the local autonomy system evolutionary on its own. The Law of Local Autonomy has taken 3 times’ full amendments in 1988, 2007 and 2020, with 36 times’ revisions in part and 24 times’ terminology changes. This paper categorizes the local autonomy system in Korea into 4 generational phases: the first one starts from the birth of the Law of Local Autonomy to 1988 when the Law was amended in full; the second is from 1988 to the full amendment in 2007; the third ranges from 2007 to 2020, when the full amendment of the Law was passed by the Korean National Assembly; the fourth generation continues from the full amendment in 2020. Ultimately, every generational phase of the Law has reflected upon the environments and situations that Korea has to adapt at the given time. The contribution of this paper is to draw social evolution perspectives for explaining the changes of the Law of Local Autonomy in Korea. However, in this paper, gene search for institutional evolution remains the next additional research.
