This paper is to interpret the allocation of the liability for the cargo between the ship owner and time charterers under the NYPE form and Baltime form under the circumstances without international uniform regulations, by constructing the major clauses and the precedent cases concerned. In the absence of express provision, the obligation to load, stow, trim and discharge the cargo is on the owners under the common law.
Clause 8 of the New York Produce Form has the effect of shifting from the owners to the charterers the primary responsibility for loading and discharging the cargo, and under Clause 2 the charterers are to provide and pay for all other usual expenses including the stevedoring expenses at port of discharge. Clause 4 of the Baltime form provides that the charterers are to "arrange and pay for" loading and unloading, which likewise, are submitted to be sufficient to transfer to the charterers the responsibility for these operations. These clauses are assessed to transfer the obligation, which would otherwise rest on the shipowner, to the charterer.
The master is submitted to have the right to supervise the cargo operations, particularly from the point of view securing the ship's safety, irrespective of the words "under the supervision of the Captain"(This was the most popular opinion in the precedent cases). Therefore leaving aside considerations of safety, he has no duty to supervise to the charterers. These words only qualify the primary responsibility that the NYPE form places on the charterers for loading and stowing the cargo.
It is found out that above main clauses regarding the responsibility for the cargo of the two charterparty forms are in common to be designed to allocate the responsibility for the cargo between ship owners and time charters, even though the words are somewhat different each other.
