This paper seeks to clarify the significance of fundamental rights in the Constitution and examine the subject of the fundamental rights from the perspective of the politics of citizenship. In our Constitution, the subject of the fundamental human rights is for the the people as a nation. This is likely to deny the humanity our neighbors who live next to us and contribute to society through various human activities on the grounds that they are not our nation. This paper will review these issues as the paradoxes of human rights and citizenship as nationality which have emerged in conjunction with modern nation-states. In conclusion, this paper suggests to revise the subject of fundamental rights from the people as a nation to every person.
