The Institute Cargo Clauses(ICC) have been continuously revised in accordance with changes of insurance market and maritime transport environment since the ICC established in 1912. The latest edition of the ICC became available to the insurance market on 1st January 2009. This article especially deals with “Exclusion Clause” which stipulates exclusion of risk for insurer among 19 clauses in the ICC. The clause first introduced in the ICC (1982).
In the ICC (2009), there have been revised 3 articles - Arts. 4, 5, and 7 - from the ICC (1982). First, insufficiency of packing has been clarified - if a container is stowed by an independent contractor prior to attachment of cover, the exclusion does not apply. Second, the word “proximately” is deleted as delay cannot be a proximate clause of loss. Third, “Insolvency Exclusion” from the “Commodity Trades Clauses” thereby covering a “purchase in good faith under a binding contract”. Fourth, nuclear fission and/or fusion exclusions have been widened in light of the increased use of nuclear material bringing them in line with the opening words of causation in the extended radioactive contamination clause. Fifth, unseaworthiness exclusion has been modified to limit the exclusion in relation to unfitness of vehicles or containers to cases where the assured or their employees are privy to such unfitness. Lastly, in the strikes exclusion, “terrorism” is defined as “caused by any person acting from a political, ideological, or religious motive”.
Therefore, in comparison with the ICC (1982), the ICC (2009) have been modified to be advantageous to the Insured and/or clarify market terms and practice. Yet, some of clauses are disadvantageous to the Insured.
