It has been about a year since Korea Communications Commission(hereinafter referred to as “KCC”) was founded. The Act on the Establishment and Management of Broadcasting and Telecommunication Commission(hereinafter referred to as “this Act”) entered into force on Feb. 28, 2008. The purpose of this Act is especially to promote freedom, public nature and public interest nature of broadcasting, and to guarantee independent operation of the KCC. However, this Act has so many problems in the legal viewpoint. It has the legal issues, for example, the systematic unfairness and the unbalance of the legal status and authority of making the government organization, also the legal status and authority of KCC in the Constitutional respect, and others. Accordingly, we are going to endeavor our study to improve and revise the systematic unfairness and the unbalance of this Act through the amendment of it in the rule of law respect. Also we will need to examine a variety of sources and interrelationship of the government organization, and to develop a legal interpretation on the constitutional material matters on the fusion between broadcasting and telecommunication. This paper is looking forward to more making a study of the legal status and authority of KCC in this Act respect.
